Dog Bites
 
Each year millions of American are bitten by dogs.
Often, the bite marks leave not only physical scarring but emotional wounds as well. A dog owner can be liable if his dog bites someone based upon the following theories; (1) negligence, (2) violation of a leash law and (3) ownership of a dog with the knowledge that the dog has a history of violence, viciousness and/or documented previous biting incidents. It is important to note, if a landlord or building owner knew or should have known that a tenant harbored a dangerous dog, that landlord/owner may be held liable under NY law for the biting of a tenant by a co tenant's dog. A number of Dog bites incidents involve dogs owned by people in your building, dogs in vacant lots, or dogs owned by someone on the street you never met before. We further understand that many dog bite cases involve close neighbors or friends and that these situations tend to be tricky and must  be treated delicately and with great care.  In most cases, it is important to understand that dog owners are often covered by insurance to protect them from such an occurrence and that a claim "put thru" the insurance does not mean that they are being "sued" in a personal capacity.
